Medical Animations: A Useful Tool in Medical Malpractice Cases

Medical malpractice in the U.S.

Medical malpractice is a big business. Estimates are the cost of medical liability in the U.S. over $ 40 billion a year. The stakes for both parties are very high. Advanced computer technology and software applications have allowed us to take medical illustration to the next level.

Plastic surgery and dermatology are very visual specialties. Often the decision is in a very clear place to see the whole world. In addition, this procedure is usually photographed by a doctor. The photo documentation included in this procedure creates a unique opportunity for useful medical illustrations during the trial.

In the case of medical negligence, information is collected from these photos, as well as medical records, surgical reports, sworn testimony, expert medical examinations, and journal or text references. To defend the credibility challenge during the trial, the information was tailored to the plaintiff's circumstances. Information is loaded onto the computer and using advanced software is enhanced into dynamic medical animations.

Animation Team

This process is coordinated by lawyers, physicians, and computer graphics artists. Lawyers set goals to emphasize animation. These goals may explain the steps and decision points involved in a particular surgery or perhaps how a revisional procedure can reduce the likelihood of damage.

Medical animation is a new tool that physicians and medical malpractice lawyers can use. They have successfully used both mediation and mediation proceedings. The use of medical illustrations is now useful but only static. Simple oral descriptions are not sufficient for aesthetic cases.

Case Report (C.L.)

The patient was a young woman who underwent conventional breast reduction. Post-operatively she developed a keloid scar. The surgeon injected it with a catalog. Peri-isolar scarring spreads and the patient complains of a deformed appearance. Medical negligence action has been filed against the surgeon alleging excessive Kenalog concentration and causing skin atrophy and scarring.

After reviewing the detailed record, the patient gained 100 lbs. and the size of her breast increased from pregnancy to surgery. Plaintiffs are required to undergo expert medical examination (E.M.E.).

The defense argued that it was extra weight, rather than the Kenalog, that caused the scars to spread. Moreover, it is said that he would benefit from a reduction in secondary breast and, based on the patient's size taken at E.M.E., the surgery would eliminate the entire area of ​​scar tissue.

Medical animations were made using patient pictures, cooperative records, measurements taken at E.M.E., textbook diagrams and computer graphics. The goal is to educate the jury on breast reduction surgery and show how secondary breast reduction will completely eliminate the patient's complaints and thus reduce any damage claimed. Medical animations were narrated and explained by the experts at the conference. The jury returned a verdict in favor of the defendant's doctor.

Case Report 2

A young woman underwent breast enlargement and reconstruction for significant asymmetry. A year later he underwent a second procedure, including a prosthesis exchange and a contralateral reduction mamaplasty. The patient experienced complications and poor outcomes from the second procedure and filed a suit against his surgeon. He then underwent a third surgical procedure to review his decision.

Three stages of surgery were created using computer-enhanced medical animations that incorporate patient records and pictures. Patients' pre-operative condition pictures are not available; therefore, computer software has been used to digitally display post-operation pictures to show its possible appearance.

Medical animations are dynamic, customizable and accurate computer graphics that allow for a better understanding of the issues related to the case. Animation costs depend on length and complexity. However, it should be weighed against the potential cost of bad decisions.
